BIDI®Youth Access Prevention Measures

BIDI VAPOR STANDS STRONGLY AGAINST YOUTH ACCESS TO THE BIDI® STICK!

The rise of underage vaping has become a challenge for the vaping industry. As such, Bidi Vapor ensured stringent measures to verify the identity of each customer and prevent unauthorized access to our BIDI® Sticks by underage vapers.

We do not offer free samples and products through vending machines, and we regularly go through our online content to ensure that we heavily discourage underage followers and only cater to adult vapers and smokers.

We also want to call on you, our wholesalers and direct retailers, to take a stand with us on our advocacy against underage vaping. Being part of the authorized direct retailers and wholesalers of our products, we need you to work with Bidi Vapor as we protect our youth from the dangers of underage vaping.

To assist you in doing this, we need you to sign our Wholesaler & Direct Retailer Agreement. Your salespeople must also require each customer to present a valid government-issued identification card, which indicates their age and other necessary information. You also have the right to put the transaction on hold when in doubt of the customer’s age eligibility.

Bidi️ Vapor has taken all the necessary steps to combat the rampant underage use of vapor products. Aside from the child-proof packaging and tamper-resistant design, we have implemented security measures to curb underage vape users from accessing the BIDI®️ Stick. We stand by the message that we do not want underage clients to access vape products. With this, Direct Retailers and Wholesalers are required to follow a strict age verification process when making a sale.

Bidi Vapor also consistently implements responsible and conscious marketing techniques to not target and/or engage adolescents in any advertisements and other marketing strategies. This complies with all labeling and packaging regulations set by the government, including addictiveness warning statements of nicotine.

Our BIDI® Stick is exclusively for adult vape users and smokers. It is in no way intended for the use of adolescents and individuals under the age of 21.

Bidi Vapor stays updated and aware of the established prevention campaigns against youth access to vape products and stands firmly by this advocacy. We are deeply committed to upholding and adhering to these regulations from California’s state laws and preventing minors from having access to the BIDI® Stick. We are also actively involved in the prohibition of sales to minors by implementing effective age restrictions, both online and offline. Our strict verification methods help restrict product sales to anyone under the required legal age.​

We do our best to prevent underage vaping online since about 86% of underage vape sales come from online purchases. However, Bidi Vapor has less control over offline underage sales; thus, we fully trust our brand partners to implement stringent measures to prevent our youth from accessing the BIDI® Sticks.

Thus, we call upon you to commit fully to preventing underage vaping at the direct retail and wholesale levels. We are deeply thankful for your important role in carrying out and ensuring that our advocacy is in place every step of the way.

Age Verification Efforts

Bidi Vapor takes the issue of underage vaping seriously. On our website, we installed an age-gating pop-up before you can gain access to the webpage. Also, our direct retailers and wholesalers require customers to present a valid government-issued identification card when purchasing BIDI® Stick.

For the direct retailer and wholesaler level, we strongly require you to follow the guidelines below:

  • Bidi Vapor created a Wholesaler & Direct Retailer Agreement. Direct retailers and wholesalers must sign, which contains the terms on purchasing and reselling the BIDI® Stick. This applies for all Bidi Vapor direct retailers. However, we strongly encourage our wholesalers to aid in any way possible to prevent distribution to minors.
  • Based on the terms, you must uphold the age verification process in your stores and commit to checking the customer’s identification before any transaction.
  • You have the authority to put the transaction on hold when in doubt or until the customer’s age is verified.
  • Mystery Shoppers will be sent to direct retailer shops to check their compliance. Failure to comply will lead to the cancellation of orders and reselling rights.

ACH Authorization and Agreement (“Authorization”)

I represent and warrant that I am the authorized owner, or an authorized agent of the authorized owner, on the checking or savings account provided by me to Kaival Brands Innovations Group, Inc. (“Kaival”) through www.bidivapor.com or its affiliate web pages (the “Site”). By clicking the “Accept” button below, I hereby authorize Kaival to withdraw the purchase price(s) specified in the applicable order confirmation(s) issued and duly executed by Kaival (“Confirmation(s)”), on the payment date(s) specified in the applicable Confirmation(s), by electronic funds transfer from the checking or savings account provided by me to the Site (the “Authorized Account”), in order to make the Requisite Payments to Kaival in exchange for products sold by or through the Site.

“Requisite Payments” means the amounts I am required to pay under the applicable sales agreement by and between myself (or my associated entity) and Kaival (the “Sales Agreement”) and the associated Confirmation(s), including any additional charges I owe, such as delivery, tax, or late fees. If the applicable due date falls on a weekend or holiday, my payment will be processed on the next business day.

I agree that this Authorization shall remain in effect, and Kaival may retain my Authorized Account information, until I am notified by Kaival that they are terminating my Requisite Payments, or until three (3) business days following the date on which I notify Kaival, in writing, that I wish to revoke this Authorization. I acknowledge and agree that revocation of my authorization does not cause a revocation or alteration of the applicable Sales Agreement or Confirmation.

I understand that Kaival may restrict or terminate payment under this Authorization, in the event that I am in default of the applicable Sales Agreement, and/or if there are insufficient funds in my checking or savings account, among other reasons.

I acknowledge that I have received a copy of this Authorization.

In the event an error is made in any ACH transfer, I hereby authorize Kaival to make any necessary transfers, to or from my Authorized Account, in order to correct the error.

I acknowledge and agree that electronic funds transfers will be made to the financial institution and account number supplied by me through the Site, and I acknowledge and agree that any errors in the provision of such information to the Site shall be solely my responsibility. I agree to indemnify, defend, and hold harmless Kaival in connection with any damages arising from such errors.

I acknowledge and agree that Kaival shall not be responsible for any aspect of the payment transaction following the point when my designated financial institution receives or has control of the payment transaction. Any loss or damage resulting from the loss of data or funds following my designated financial institution’s receipt of payment (or control of payment) shall be solely my responsibility, or the responsibility of my designated financial institution.

I acknowledge that Kaival shall be responsible for employing commercially reasonable means to safeguard my data, but shall not be responsible for any virus, data breach, theft, glitch, error, force majeure, or related event affecting my Authorized Account information, so long as such commercially reasonable means are employed.

This Authorization shall be governed by the Sales Agreement then in effect between me (or my affiliated entity) and Kaival. In the absence of an effective Sales Agreement, this Authorization shall be governed by the terms and conditions of sale set forth on the Site at the time of my signature below.

IN NO EVENT SHALL KAIVAL BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS (EVEN IF ADVISED OF THE POSSIBILITY THEREOF) ARISING IN ANY WAY OUT OF THIS AUTHORIZATION OR THE TRANSACTIONS CONTEMPLATED HEREIN, ABSENT KAIVAL’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
